This website is operated and owned by YOGA LOFT LTD. Registered in England at 89-91 Union Street, Plymouth, Devon, United Kingdom, PL1 3NB company number 11394878.
These terms and conditions provide general terms and conditions for the use of our website and relating to the services provided by the Yoga Loft website and in our studio.
Our Terms and Conditions are applicable to all Students and any Membership that is subject to these Terms and Conditions may be amended occasionally.
Yoga Loft Ltd reserves the right to amend and or revoke Terms and Conditions that it may consider necessary for the regulation of the internal operation of the Studio and/or the conduct of our Members. If so, such changes will be published on our Website and, until removed or revoked, are binding on our Members.
Please read these terms and conditions carefully. Using our Website or the purchase of any Products or Services on the Website or in Studio is subject to these terms and conditions. And you now hereby agree to our terms and conditions.
Terms & Conditions
Yoga Loft classes are always subject to availability although we will always try our very best to accommodate students in their chosen class.
All classes must be pre booked and all students agree to our 24-hour notice policy for cancelling or rescheduling. If you are booked into a class, do not attend or cancel with less than 24hrs notice, you may still be charged for it.
Out of consideration for our teachers and other members, and also for your own safety (as warming up is an important part of each class) if you are more than 5 minutes late, you may not be able to participate in the class.
Health Readiness for Physical Activity
Students that have low or high blood pressure or cardiac irregularities should not attend classes until they have obtained written permission from their doctor. If there is any doubt, the Student should consult his/her doctor. Students MUST notify the Studio of any circumstances affecting their health or mental wellbeing which may be exacerbated through use of the Studio.
Important Notice
The information available on or through our website, and the Services supplied or in connection with Yoga loft Limited do not constitute medical advice and you are responsible to determine, through obtaining appropriate medical advice you are fit and well and that the services provided are both suitable and safe for you. Before commencing any new exercise regime, you should consult your doctor.
In consideration of Yoga Loft Limited accepting a New Student/Member, it is agreed that:
Neither Yoga Loft Limited, nor its Teachers, Partners or employees are responsible for any injuries suffered caused whole or in part by the Member’s failure to follow the relevant instructions of the Teachers or by any physical impairment not fully disclosed to the Studios in writing.
It is essential that you supply us with correct information about yourself as we cannot be held liable for any incorrect information given. Yoga Loft will endeavour to make sure that the information contained on or website and provided to you is correct, but we do not accept any liability for any errors and exclude all liability for any action you or any legal representative may take or loss or injury you may suffer direct as a result of relying on any information on this website or provided through any of the Services that are supplied by us to you.
Neither Yoga Loft Limited, nor its partners, Teachers and employees are responsible for loss or damage to a Member/Student personal belonging. Yoga Loft Limited reserves the right to change the class timetable, including cancellation of any classes and or change of Teacher without notice.
You, your legal representatives release waives, discharge and covenant, not to sue Yoga Loft Limited and its instructors for any injury or death caused by your personal negligence or other acts.
PERSONAL BELONGINGS, DRESS CODE & SAFETY
For security reasons some doors in the studio may be locked Students are advised to place all their belongings in a safe place including using the shelves in the studios.
Students are required to wear suitable clothing for a Yoga Class. Topless, underpants, offensive slogans, swimming costumes etc are not considered appropriate. The Studio space is a SHOE FREE AREA. All outdoor footwear must removed as soon as possible and left in the reception area.
For safety reasons Students are not permitted to bring glass or anything breakable in any part of the Main Studio. No food is to be consumed within the Main Studio space. Students must not walk around the Studio barefoot if they have verruca’s or similar foot issues. In the event of a fire, Students are asked to make their way to the nearest available exit.
Warranties
Yoga Loft Limited warrants all Services will be supplied with reasonable skill and care. Statutory Refund Rights and Cancellation Studio Memberships and all other types of class bookings available are not transferable sessions and are not permitted to be used by anyone other than the said Student or Member. Any assignment transfer or disposal of courses is at the sole discretion of the Yoga Loft and may only be permitted in exceptional circumstances. Class fees are non-refundable if the correct terms are not adhered to.
Membership fees and Class fees may be increased by Yoga Loft Ltd at any time. The Proprietor will give no less than 28days notice prior to any such increases.
Class Timetables at the Studio may change from time to time. These changes will be published by the Studio and will be available at the Studio or directly on our Website.
Any pre booked Classes must be cancelled within 24 hrs, in person or online. In any other case, the class will be charged/deducted from the remainder of the Students membership plan/course.
When booking a class, you are booking for a class and not a Teacher. Class instructors may be subject to change with or without notice.
The rights of cancellation and refund expressed in these terms and conditions do not affect your statutory rights as a consumer. Refunds in relation to our Services will only be credited back to the original payment method/ credit or debit card used to make the purchase.
All Membership Plans are 30 day rolling contracts, after initial start-up fees all subsequent fees are collected by monthly direct debit which can be cancelled at any time given 30 days’ notice.
The Introductory Studio trials expires in 30 days and starts from the date the first class is taken.
Definitions
In these terms and conditions, the following definitions apply: “Services” means any information and services ordered and/or provided by Yoga Loft Limited through or via the Site or our studios and all services offered as part of any course or workshop. Any electronic information supplied to you by Yoga Loft Limited will constitute part of “Service” not a Product and cancellation rights will apply accordingly. “Products” means any products offered for sale on the Site or in a Yoga Loft Limited studio. “Site” means the web site at the www.yogaloft.co.uk from time to time. Use of this Site Generally “Yoga Loft” is the trading name of YOGA LOFT Ltd As such all reference to Yoga Loft includes Yoga Loft Limited.
Site Usage and Intellectual Property Rights
You must not use the Yoga loft website to post, upload or otherwise transmit material which is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this Site or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or damage or destroy the reputation of Yoga Loft Limited.
Yoga Loft Limited accepts no obligation to monitor the use of the Site. However, reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Yoga Loft Limited will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security. You should refresh your browser each time you visit the Site to ensure that you download the most up to date version of the Site as we may change the site from time to time.
Your Personal Information
Usage of your personal information is governed by the Yoga Loft privacy policy, which forms part of these Terms and Conditions.
Liability
You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this Site and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Yoga Loft Limited does not enter into conditions, warranties or other terms in relation to the Site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.
The Site may include links to external sites and co-branded pages. Yoga Loft Limited has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting, However, Yoga Loft Limited is not responsible for the content of these site and pages or for anything provided by them.
Subject to the important liability statement, Yoga Loft Limited is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.
Suspension and termination of Service
Yoga Loft Limited may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will be not necessarily be uninterrupted or error free.
Yoga Loft Limited may terminate the Service immediately in the event you breach any of these terms and conditions or do not pay any sums due to Yoga Loft Limited (including if the credit/debit card you use is not valid or does not work for another reason).
USE OF FACILITIES AND CHILDREN
Children under the age of 16yrs are NOT permitted to enter the studio unaccompanied by an adult.
Classes start promptly at the advertised times. Members need to arrive at the Studios with enough time to change and enter the yoga studio before the class starts. Members arriving at reception once the instructor has started class may not be allowed to attend that class.
Members are ONLY entitled to use the Studios’ facilities when attending a class.
Cubbies/ Shelves are available to Members while they are attending class and are emptied every night. Any items left at the end of the day are placed in lost property.
Bicycles are to be left at street level or in selected areas and are not permitted on any other part of the premises.
All lost and left property is disposed of within 14 days with the exception of towels which are disposed of on a daily basis.
Contract Information
No contract will exist in relation to the Services or Products until we have confirmed to you by email the particulars of your order, the value of your order and the Products or Services (as applicable) you have purchased.
Pricing
Information displayed on the Site or in our studio as to pricing and availability is subject to change by Yoga Loft Limited without notice.
ONLINE RESERVATIONS
Class size is limited and Yoga Loft Limited operates a “first come first served” booking policy. However, the Studios offer online reservations for Members who always hold priority
A reservation holds a space in a class until 10 minutes before the start of class. All unallocated spaces are returned to “first come first served” spaces for that class.
A reservation can only be claimed by attending at reception and advising the receptionist you are present.
A Member arriving with less than 10 minutes before the start of class is not guaranteed a space in that class.
Any Member who regularly books online and fails to show up for class without cancelling will be blocked from booking online.
General
Yoga Loft Limited may change these terms and conditions from time to time. By browsing the Site, you are accepting that you are bound by the current terms and conditions. You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
